Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and JeyStack LLC ("JeyStack," "we," "our," or "us") governing your access to and use of the Gita Streak mobile application and any related services, content, or features (collectively, the "Service").

By downloading, installing, creating an account for, or otherwise using the Service, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through the app or by email. Your continued use of the Service after such changes constitute your acceptance of the updated Terms.

2. Description of Service

Gita Streak is a mobile application available on iOS and Android that helps users develop a daily habit of engaging with the teachings of the Bhagavad Gita. The Service includes:

• Bhagavad Gita Lessons. A structured library of bite-sized, approachable lessons drawn from the 18 chapters and 700 verses of the Bhagavad Gita, designed for modern learners.
• Streak Tracking. A daily streak system that encourages consistent engagement by tracking consecutive days of lesson completion and rewarding habit formation.
• Karma Coins. A virtual in-app reward currency earned through completing lessons, maintaining streaks, and achieving milestones. Karma Coins may be used to unlock certain in-app features or content as described within the app.
• Gopi Guide Character. An animated in-app guide character named Gopi who accompanies users through lessons, provides encouragement, and delivers contextual commentary to enrich the learning experience.
• Quizzes and Progress Tracking. Interactive quizzes and progress indicators to reinforce learning and help users track their journey through the content.

The content of the Service is intended to be educational and inspirational in nature. We may update, modify, or discontinue features of the Service at any time at our discretion.

3. Eligibility

The Service is intended for users who are at least 13 years of age. By creating an account or using the Service, you represent and warrant that you are at least 13 years old. We do not knowingly permit users under the age of 13 to create accounts or use the Service. If we learn that a user is under 13, we will promptly terminate their account and delete their personal information in accordance with our Privacy Policy.

Users who are at least 13 but under 18 years of age ("Minors") may use the Service only with the involvement, supervision, and consent of a parent or legal guardian. By allowing a Minor to use the Service, the parent or guardian agrees to be bound by these Terms on the Minor's behalf and accepts responsibility for the Minor's use of the Service.

4. Account Registration

To access certain features of the Service, you must create an account. When creating your account, you agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain and promptly update your account information to keep it accurate and complete.
• Maintain the confidentiality of your account credentials and not share your password with any third party.
• Accept responsibility for all activities that occur under your account, whether or not authorized by you.
• Notify us immediately at support@jeystack.com if you suspect unauthorized access to or use of your account.
• Maintain only one active account. Creating multiple accounts to circumvent restrictions, accumulate Karma Coins artificially, or for any other reason is a violation of these Terms.

We reserve the right to refuse registration, suspend, or terminate accounts in our sole discretion, including where we believe that account information is false or misleading, or that the account is being used in violation of these Terms.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. Without limiting the foregoing, you agree that you will not:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app or any underlying software, except to the limited extent expressly permitted by applicable law notwithstanding this restriction.
• Scrape, crawl, spider, or use any automated means to access, collect, or index any portion of the Service or its content without our express written permission.
• Attempt to gain unauthorized access to any portion of the Service, other user accounts, or our servers, networks, or systems.
• Submit, post, or transmit any content that is hateful, discriminatory, harassing, defamatory, obscene, or otherwise objectionable.
• Impersonate any person or entity, including JeyStack LLC employees or other users, or falsely represent your affiliation with any person or entity.
• Use the Service to transmit unsolicited commercial communications (spam), malware, or any content designed to interfere with or disrupt the Service.
• Sell, resell, rent, or sublicense access to the Service or any of its content.
• Use the Service in any manner that could disable, overburden, damage, or impair our servers or networks, or interfere with any other party's use and enjoyment of the Service.
• Remove, alter, or obscure any proprietary notices, labels, or marks on the Service or its content.
• Use the Service for any commercial purpose or for the benefit of any third party without our prior written consent.

We reserve the right to investigate any violation of these rules and to take appropriate action, including removing content, suspending or terminating accounts, and reporting violations to law enforcement authorities.

7. Intellectual Property

The Service and all of its content, features, and functionality — including but not limited to the Gita Streak name and logo, the Gopi guide character and all associated artwork and animations, lesson text and curriculum, quiz content, user interface design, software, and all other copyrightable material — are the exclusive property of JeyStack LLC or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

JeyStack LLC grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes in accordance with these Terms. This license does not include any right to copy, modify, distribute, sell, or exploit any part of the Service or its content.

To the extent you submit, upload, or otherwise provide any content, feedback, or suggestions to us through the Service (collectively, "User Content"), you grant JeyStack LLC a worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with operating, improving, and promoting the Service. You represent and warrant that you own or have the necessary rights to grant this license and that your User Content does not infringe the rights of any third party.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JEYSTACK LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, JeyStack LLC does not warrant that: (i) the Service will meet your specific requirements; (ii) the Service will be uninterrupted, timely, secure, or error-free; (iii) any errors or defects in the Service will be corrected; or (iv) the Service or its servers are free of viruses or other harmful components.

The spiritual and philosophical content provided through the Service — including all lessons, commentary, and guidance from the Gopi character — is intended solely for educational and inspirational purposes. It does not constitute religious advice, psychological counseling, mental health treatment, or professional guidance of any kind. Users should not rely on any content within the Service as a substitute for professional advice from qualified practitioners.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JEYSTACK LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF JEYSTACK LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JEYSTACK LLC'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF: (i) THE TOTAL AMOUNT PAID BY YOU TO JEYSTACK LLC IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (ii) ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain types of damages, so some of the above limitations may not apply to you. In such jurisdictions, JeyStack LLC's liability will be limited to the greatest extent permitted by applicable law.

10. Indemnification

You agree to defend, indemnify, and hold harmless JeyStack LLC and its officers, directors, employees, contractors, agents, licensors, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way related to: (i) your access to or use of the Service; (ii) your breach or alleged breach of these Terms; (iii) your violation of any applicable law or regulation; (iv) your violation of any third-party rights, including intellectual property rights or privacy rights; or (v) any User Content you submit to the Service.

JeyStack LLC reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate fully with us in asserting any available defenses.

11. Governing Law and Dispute Resolution

Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact us at support@jeystack.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days of receiving your notice. If we are unable to resolve the dispute informally within that period, either party may proceed to the binding arbitration process described below.

Binding Arbitration

Except as expressly set forth in this Section, any dispute, claim, or controversy arising out of or relating to these Terms or the Service, or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved by final and binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules, as amended from time to time. The arbitration shall be conducted in the English language. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights or confidential information pending resolution of the dispute by arbitration.

Class Action Waiver

Small Claims Court Exception

Notwithstanding the foregoing, either party may bring an individual action in a small claims court of competent jurisdiction, provided the claim qualifies for such court and the action remains in small claims court and is not removed or appealed to a court of general jurisdiction.

12. Changes to These Terms

We reserve the right to modify or update these Terms at any time in our sole discretion. When we make material changes to these Terms, we will notify you by updating the "Last Updated" date at the top of this document and by providing notice through the app or via email to the address associated with your account. We may also require you to affirmatively accept the updated Terms before continuing to use the Service.

Your continued use of the Service following notice of any changes to these Terms constitutes your acceptance of such changes. If you do not agree to the updated Terms, you must stop using the Service and may delete your account at any time.
